Terms and Conditions
The following are the Terms and Conditions (the "Agreement") which govern your access and use of our online platform through which emotional life coaching may be provided (collectively the "Platform"). This website is owned and operated by Empathy On Call, located in Madagascar (samdanielart22@gmail.com). Although the customers of the business are worldwide, with a primary presence in North America and Europe, Empathy On Call is physically registered and operates under the laws and regulations of Madagascar.
By accessing or using the Platform, you are entering into this Agreement. You should read this Agreement carefully before starting to use the Platform. If you do not agree to be bound by any term of this Agreement, you must not access the Platform.
When the terms "we", "us", "our" or similar are used in this Agreement, they refer to Empathy On Call, the company that owns and operates the Platform (the "Company").
IMPORTANT NOTICE: THIS AGREEMENT IS SUBJECT TO BINDING ARBITRATION AND A CLASS ACTION WAIVER AS DETAILED IN SECTION 7.
The Provider and Services
The Platform is used to connect users with an emotional life coach ("the Provider") who will provide emotional life coaching services to you through the Platform. The Provider is not licensed to offer mental health counseling and does not provide mental health services of any kind.
Although emotional life coaching can be beneficial in addressing various emotional and personal development concerns, it is not a substitute for licensed professional therapy or counseling. The Provider does not make any claims of mental health expertise, diagnosis, or treatment, and this service is not intended to address severe emotional or psychological issues that require a licensed therapist or counselor.
If you are in need of professional mental health treatment or therapy, you should consult a licensed mental health professional. The Provider's services are not to be interpreted as therapy or counseling and do not require any license typically associated with such practices.
Emergency Situations
IF YOU ARE THINKING ABOUT SUICIDE, HARMING YOURSELF OR OTHERS, OR IF YOU BELIEVE ANYONE ELSE MAY BE IN DANGER, YOU MUST IMMEDIATELY CALL YOUR LOCAL EMERGENCY SERVICES NUMBER AND NOTIFY THE RELEVANT AUTHORITIES. THE PLATFORM IS NOT DESIGNED FOR USE IN THESE EMERGENCY CASES AND THE PROVIDER CANNOT OFFER THE ASSISTANCE REQUIRED IN SUCH SITUATIONS. IF YOU CHOOSE TO USE THE PLATFORM IN SUCH CASES, YOU DO SO AT YOUR OWN RISK.
Privacy and Security

BY AGREEING TO THIS AGREEMENT AND/OR BY USING THE PLATFORM, YOU ARE ALSO AGREEING TO THE TERMS OF THE PRIVACY POLICY. THE PRIVACY POLICY IS INCORPORATED INTO AND DEEMED A PART OF THIS AGREEMENT.
Disclaimer of Warranty and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY NATURE RESULTING FROM THE PROVIDER'S SERVICES OR THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE OF THE PROVIDER AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, NON-INFRINGEMENT, SECURITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY. THE USE OF THE PLATFORM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.
Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of Madagascar. Any dispute arising from or related to the use of the Platform, including but not limited to any action, claim, or lawsuit, shall be resolved through binding arbitration, and you agree to waive any right to a jury trial.
